Perigee Capital Partners, LLC., which does business as Constellant knows that you care how your data is used and shared when you do business with us, and we appreciate your trust and assure you that we do so carefully and sensibly.
What is Covered by this Privacy Policy

This Constellant Privacy Policy describes how we collect and use information that you provide to us in connection with the creation of your dpEngine instance (e.g., your portal), which we refer to as "Account Information". For Example, Account Information may include names, usernames, phone numbers, email addresses, connection information, and billing information associated with your personnel who have an account on our web portal which is used to manage your portal.

If you contract us to do so, when we set up a portal for you, you will need to provide us with your Privacy Policy that you want to apply to the account information and content that you place on your portal to support your customers (i.e., end-users), including any personal information of your end-users. Your customer information belongs to you and Constellant will not disclose, move, access or use customer content except as required for us to provide you with the services that is in your agreement with Constellant. How Constellant Uses Account Information

Constellant and our subsidiaries all follow the same policy. When you visit the Constellant site or you enter into an agreement with us to provide you with a portal, you are accepting the practices described in this policy. The personal data that we collect about you is used solely for the purpose of maintaining your business relationship with us.

What Personal Information About Customers Does Constellant Gather?

The information we learn from our customers is used to personalize and continually improve your Constellant experience. Here are the types of information we gather.

Information You Give Us: We receive and store any information you enter on our Web site or give us in any other way. You can choose not to provide certain information, but then you might not be able to take advantage of many of our features. We use the information that you provide for such purposes as responding to your requests, customizing future site visits, and communicating with you.

Automatic Information: We receive and store certain types of information whenever you interact with us. For example, like many Web sites, we use "cookies," and we obtain certain types of information when your Web browser accesses Constellant or advertisements and other content served by or on behalf of Constellant on other Web sites.

E-mail Communications: To help us make e-mails more useful and interesting, we often receive a confirmation when you open e-mail from Constellant if your computer supports such capabilities. We also compare our customer list to lists received from other companies, in an effort to avoid sending unnecessary messages to our customers. If you do not want to receive e-mail or other mail from us, please adjust your Customer Communication Preferences in your account at support.constellant.com.

Information from Other Sources: We might receive information about you from other sources and add it to our account information.

What About Cookies?

Cookies are unique identifiers that we transfer to your device to enable our systems to recognize you and your device such that your experience is more seamless.

The Help feature on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Additionally, you can disable or delete similar data used by browser add-ons, such as Flash cookies, by changing the add-on's settings or visiting the Web site of its manufacturer. Because cookies allow you to take advantage of some of Constellant's essential features, we recommend that you leave them turned on. For instance, if you block or otherwise reject our cookies, you will not be able to use Constellant products and services that require you to Sign in.

Does Constellant Share the Information it Receives with third parties?

Information about our customers is an important part of our business, and we are not in the business of selling it to others or sharing it without purpose. We share customer information only as described below and with subsidiaries Constellant controls that either are subject to this Privacy Notice or follow practices at least as protective as those described in this Privacy Notice.

Suppliers We Do Not Control: We use suppliers to host the computers for the services that we offer. All of your data is encrypted to prevent access by these suppliers and as an additional precaution, we have contracts with them that prevent them from looking at or copying your data.

Third-Party Service Providers: We employ other companies to perform functions on our behalf. Examples include sending postal mail and e-mail, providing search results and links (including paid listings and links), and processing credit card payments. They only have access to personal information needed to perform their functions, and contractually may not use it for any other purpose other than providing the service contracted.

Promotional Offers: Sometimes we might send offers to selected groups of Constellant customers on behalf of other businesses that we believe will provide those customers with benefits. If and when we do this, we do not give that business your name and address. If you do not want to receive such offers, please adjust your Communication Preferences at support.constellant.com.

As we continue to develop our business, we might sell or buy subsidiaries, or business units. In such transactions, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Notice (unless, of course, the customer consents otherwise). Also, in the event that Perigee LLC, or substantially all of its assets are acquired, customer information will of course be one of the transferred assets.

Law Enforcement: We will release account and other personal information only when we are required to comply with a lawful court order to meet national security or law enforcement requirements.

How Secure is Information About Me?

We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input.

We NEVER see or store your credit card information. Instead, we use a Payment Card Industry (PCI) compliant service which will handle the secure entry of any credit card information and the secure transmittal to the appropriate credit card company during order processing.

What About Third-Party Advertisers and Links to Other Websites?

Our site may include third-party product information with links to other Web sites for our partners who add value on top of our offerings such that you will have a more complete solution. The third-party information and advertising that we post is only about products and technology that are specifically designed to work with our products and technologies and that can potentially add value to you.

Which Information Can I Access?

You have the right to access your personal information held by Constellant. We give you access your personal information about your account and your interactions with Constellant for the purpose of viewing and, in certain cases, updating that information. You can update your information at any time by logging in to support.constellant.com and updating the information in your account profile.

What Choices Do I Have?

As discussed above, you can always choose not to provide optional information.

If I Ask, Will You Delete My Data?

If you no longer wish to have us hold any of your personal data, you can request that we delete your information from our systems by sending an email to privacy@constellant.com along with the email address that you registered with. We will make every reasonable effort to delete your personal information from our systems unless there is a contractual or lawful reason that we are required to retain it.

Are Children Allowed to Use constellant.com?

constellant.com is designed for businesses and we do not sell products intended for the purchase by children.

Does Constellant Participate in the EU-U.S. Privacy Shield Framework?

Constellant complies with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework (Privacy Shield) as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and the United Kingdom and Switzerland to the United States in reliance on Privacy Shield. Constellant has certified to the Department of Commerce that it adheres to the Privacy Shield Principles with respect to such information. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. What Are My Recourse Mechanisms If I Have An Issue With My Privacy Rights?

In compliance with the Privacy Shield Principles, Constellant commits to resolve complaints about our collection or use of your personal information. EU and Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact Constellant via email at: privacy@constellant.com

Constellant has further committed to refer unresolved Privacy Shield complaints to JAMS, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please contact or visit https://www.jamsadr.com/file-an-eu-us-privacy-shield-or-safe-harbor-claim for more information or to file a complaint. The services of JAMS are provided at no cost to you. Conditions of Use, Notices, and Revisions

If you choose to visit Constellant, your visit and any dispute over privacy is subject to this Notice and our Conditions of Use posted on the site including limitations on damages, resolution of disputes, and application of the law of the state of Texas. Our business changes constantly, and our Privacy Notice and the Condition of Use will change also. We may e-mail periodic reminders of our notices and conditions, but you should check our Web site frequently to see recent changes. Unless stated otherwise, our current Privacy Notice applies to all information that we have about you and your account. We stand behind the promises we make, however, and will never materially change our policies and practices to make them less protective of customer information collected in the past without the consent of affected customers.

You provide most such information when you search, buy, post, participate in a contest or questionnaire, or communicate with customer service. For example, you provide information when you search on a web site; place an order through Constellant; provide information in your account profile; communicate with us by phone, e-mail, or otherwise; complete a questionnaire; raise a support ticket; and participate in Discussion Forums or other community features. As a result of those actions, you might supply us with such information as your name, address, and phone numbers; and e-mails to us.

Automatic Information

Examples of the information we collect and analyze include the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information such as browser type, version, and time zone setting, browser plug-in types and versions, operating system, and platform; the full Uniform Resource Locator (URL) clickstream to, through, and from our Web site, including date and time; cookie number. We may also use browser data such as cookies, Flash cookies (also known as Flash Local Shared Objects), or similar data on certain parts of our Web site for system security and other purposes. During some visits we may use software tools such as JavaScript to measure and collect session information, including page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.
